PlantClassifieds.com ("PlantClassifieds", "we", "us", "our") operates a website and related services at plantclassifieds.com (the "Site") that let businesses and individuals advertise plant, tool, and construction equipment for hire, and let others search and browse those advertisements. Our registered company details, address, and contact information are set out in Clause 22.

These Terms & Conditions ("Terms") form a legal agreement between you and PlantClassifieds. By creating an account, posting a listing, or otherwise using the Site, you agree to be bound by them. If you don't agree, please don't use the Site. Our Privacy Policy and any listing-specific guidelines referenced from the Site are incorporated into these Terms by reference.

Advertiser

a User who posts a Listing offering Equipment for hire.

Hirer

a User who contacts an Advertiser about, or enters into a hire agreement for, Equipment found through the Site.

Equipment

any plant, tool, machinery, vehicle, or attachment advertised on the Site, from small tools to heavy plant.

Listing

an advertisement for Equipment posted by an Advertiser, including its description, photos, price, and availability.

Hire Agreement

the separate contract formed directly between an Advertiser and a Hirer for the hire of Equipment, on whatever terms they agree between themselves.

User

anyone who uses the Site, including Advertisers and Hirers, whether or not they hold an account.

Content

text, images, video, ratings, reviews, or other material submitted to the Site by a User.

PlantClassifieds provides a venue for Advertisers to list Equipment and for Hirers to find it. We are a classifieds and listings platform only. We do not own, hold, store, inspect, maintain, insure, deliver, collect, or operate any Equipment listed on the Site, and we are not a plant hire company.

When a Hirer contacts an Advertiser, and whenever a Hire Agreement is formed, that agreement is made directly and solely between the Advertiser and the Hirer. PlantClassifieds is not a party to it, does not countersign or guarantee it, and does not process payment for it unless a specific paid feature on the Site says otherwise at the time you use it. Terms of hire — price, deposit, delivery, damage liability, insurance, operator requirements, and duration — are matters for the Advertiser and Hirer to agree between themselves.

We do not vet Advertisers or Equipment before a Listing goes live, and a Listing appearing on the Site is not an endorsement, verification, or guarantee of the Equipment's condition, safety, legality, availability, or of the Advertiser's identity, competence, or right to hire it out.

You must be at least 18 years old and able to form a binding contract under the law of England and Wales to create an account or post a Listing. If you're using the Site on behalf of a business, you confirm you have the authority to bind that business to these Terms.

• You're responsible for the accuracy of the information on your account and for keeping your login credentials confidential.
• You're responsible for all activity carried out through your account, whether or not you personally carried it out, unless it results from our failure to secure the Site.
• One account per business or individual, unless we agree otherwise in writing — duplicate accounts used to circumvent suspension or fees will be closed.
• Tell us promptly at the contact details in Clause 22 if you suspect unauthorised use of your account.

By posting a Listing, you (the Advertiser) confirm that:

• you own the Equipment, or otherwise have the legal right to offer it for hire (for example as its registered hire company, dealer, or authorised agent);
• the description, photographs, specifications, availability, and condition stated are accurate and current, and any known defects or limitations are disclosed;
• the price shown is the full, honest price for the advertised hire period — mandatory fees that a Hirer will unavoidably have to pay (such as compulsory damage waiver, delivery, or fuel surcharges) are stated up front rather than added later, in line with the drip-pricing and transparency rules under the Digital Markets, Competition and Consumers Act 2024;
• the Equipment complies with applicable UK safety and product legislation for its type, including as relevant the Provision and Use of Work Equipment Regulations 1998 (PUWER), the Lifting Operations and Lifting Equipment Regulations 1998 (LOLER), and CE/UKCA marking requirements, and that any statutory inspection or thorough examination certificates are current and will be made available to a Hirer on request;
• you hold adequate insurance for the Equipment you hire out, appropriate to its type and use; and
• you'll honour a Listing's stated availability and price for any Hirer who relies on it in good faith, and update or remove the Listing promptly once the Equipment is no longer available.

We may edit a Listing for formatting or category placement, decline to publish it, or remove it, at our reasonable discretion — including where we believe it breaches Clause 9. We aren't obliged to explain every such decision, though we'll tell you if we remove a live Listing where practical to do so.

If you're a Hirer, the Site helps you find Equipment — it doesn't do your due diligence for you. Before agreeing to hire anything found through the Site, you should independently satisfy yourself as to the Equipment's condition, safety, and suitability for your purpose, the Advertiser's identity and legitimacy, and current statutory inspection or insurance documentation for the Equipment (ask the Advertiser to provide it — see Clause 5).

Any Hire Agreement, deposit, payment, delivery, collection, and damage arrangement is between you and the Advertiser. We recommend getting hire terms confirmed in writing before Equipment changes hands. PlantClassifieds has no visibility into, and no responsibility for, what happens after you and an Advertiser make contact.

Browsing and searching the Site is free. Where we charge Advertisers for listing packages, featured placement, or subscriptions, the price and billing terms are shown before you pay and are non-refundable once the service has been provided, except where required by law or stated otherwise at checkout.

Fees you pay us relate solely to advertising space on the Site. They are separate from, and not a payment towards, any hire charge, deposit, or damage waiver owed under a Hire Agreement — those are paid directly to the Advertiser unless a specific in-Site payment feature says otherwise at the time you use it.

Reviews must reflect a genuine experience of the Advertiser or the hired Equipment. You must not post, commission, or incentivise a review — positive or negative — that doesn't reflect a real transaction, and Advertisers must not offer payment, discounts, or other incentives in exchange for reviews, or suppress genuine negative reviews other than by reporting ones that breach these Terms. This reflects the fake-review provisions in force under the Digital Markets, Competition and Consumers Act 2024. We may remove reviews that breach this clause and may suspend accounts that repeatedly post or solicit fake reviews.

You must not use the Site to:

• list Equipment you don't own or have no right to hire out, or list stolen, counterfeit, or unregistered Equipment where registration is required by law;
• post false, misleading, or deceptive Listings, including understated prices that omit mandatory charges, or images that don't genuinely represent the Equipment on offer;
• post fake reviews or ratings, or manipulate the review system as described in Clause 8;
• advertise Equipment that is unsafe, breaches applicable safety regulation, or lacks the certification legally required for its type;
• post duplicate, spam, or off-topic Listings, or Listings for anything other than plant, tool, or construction equipment hire;
• harass, defraud, or attempt to circumvent the Site to avoid fees, or scrape, resell, or systematically extract Site data without our written permission;
• post unlawful, defamatory, hateful, obscene, or infringing Content; or
• impersonate another person or business, or misrepresent your affiliation with one.

We may remove Content, suspend or terminate accounts, and report suspected criminal conduct (such as listing stolen equipment) to the police, in each case without prior notice where we reasonably believe this clause has been breached.

If you believe a Listing or other Content is illegal, fraudulent, unsafe, or breaches these Terms, please report it using the "Report" link on the Listing or by contacting us at the details in Clause 22, with enough detail for us to investigate. We review reports of illegal content and act on well-founded ones, consistent with our obligations under the Online Safety Act 2023, and we'll aim to acknowledge reports within a reasonable time. Submitting a report doesn't guarantee a particular outcome, and we use our judgement in applying these Terms.

Because PlantClassifieds is not a party to any Hire Agreement, we are not responsible for: the condition, safety, roadworthiness, or fitness for purpose of any Equipment; an Advertiser's or Hirer's conduct, solvency, or compliance with the law; the accuracy of a Listing; any loss, injury, or damage arising from the hire, use, delivery, or return of Equipment; or any dispute between an Advertiser and a Hirer, including over price, damage, deposits, or cancellation. Disputes about a Hire Agreement are between the Advertiser and the Hirer to resolve, including through the ordinary consumer or commercial remedies available to them.

Nothing in this clause is intended to exclude or limit either party's own legal responsibilities to the other under a Hire Agreement, over which we have no control and take no part.

The Site's design, code, branding, and any content we create ourselves belong to PlantClassifieds or our licensors. You may not copy, reproduce, or create derivative works from it without our written permission, beyond what's needed for ordinary use of the Site.

You keep ownership of Content you post (such as Listing photos and descriptions), but by posting it you grant PlantClassifieds a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute it for the purposes of operating and promoting the Site — for example, showing your Listing in search results or Site marketing. This licence ends when you remove the Content or close your account, except for copies already reasonably retained for backups, legal compliance, or records of past Listings.

The Site is provided "as is" and "as available". To the extent permitted by law, we don't warrant that the Site will be uninterrupted, error-free, or secure, or that any Listing is accurate, current, or complete. Nothing in this clause affects your statutory rights as a consumer, which aren't excluded by these Terms.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.

Subject to that, PlantClassifieds is not liable for: any Hire Agreement or dealings between Advertisers and Hirers (see Clause 11); indirect or consequential loss, including lost profits, lost bookings, or business interruption; or Content posted by Users. Where we are found liable to you for any other loss arising from your use of the Site, our total liability is limited to the greater of £100 or the fees you've paid us in the 12 months before the claim arose.

You agree to indemnify PlantClassifieds against reasonable losses, costs, and claims arising from your breach of these Terms, your Content, or your use of the Site, except to the extent caused by our own breach or negligence.

We process personal data in line with UK data protection law, including the UK GDPR and the Data Protection Act 2018. Our Privacy Policy explains what we collect, why, and your rights over it, and forms part of these Terms. We use cookies and similar technologies as described in our Cookie Policy.

You may close your account at any time by contacting us. We may suspend or terminate your account or remove Content, with notice where reasonably practicable, if you materially breach these Terms, we're required to by law, or we reasonably believe it necessary to protect the Site or other Users — for example, in response to fraud, unsafe listings, or repeated fake reviews. We'll aim to give you a chance to put things right first, except where the breach is serious or repeated, or immediate action is needed for safety or legal reasons.

We may update these Terms from time to time, for example to reflect changes in the law or how the Site works. We'll post the revised Terms with an updated effective date, and where a change is material we'll take reasonable steps to notify registered Users in advance. Continuing to use the Site after a change takes effect means you accept the updated Terms.

If something's gone wrong with the Site itself — as opposed to a dispute with another User about a Hire Agreement, which is between you and them — contact us at the details in Clause 22 and we'll do our best to resolve it. UK-based consumers may also be able to use the Citizens Advice consumer service or a relevant Alternative Dispute Resolution provider; we'll confirm at the time whether one applies to your complaint.

• Severability — if any part of these Terms is found unenforceable, the rest continues to apply.
• No waiver — our not enforcing a term on one occasion doesn't stop us enforcing it later.
• Assignment — we may transfer these Terms in connection with a merger, sale, or reorganisation of our business; you may not transfer your account without our consent.
• Entire agreement — these Terms, together with the policies they reference, are the whole agreement between you and PlantClassifieds regarding the Site.

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from them, save that if you're a consumer resident elsewhere in the UK, mandatory consumer protections of your home nation and the right to bring proceedings in your local courts are unaffected.
